Terms and Conditions

The Competition starts on October 10th, 2024 and ends on November 3rd, 2024.


PICO proudly presents the 2024 Intel x PICO VR Sports Competition (the "Competition"). Participation in the Competition is governed by any Competition details provided in website Announcements and by these terms and conditions (collectively, the “Terms”) . Any alleged or actual ambiguity, discrepancy or inconsistency between the website, announcements, and these Terms, these Terms shall prevail. Participation in the Competition is not subject to any payment and constitutes each entrant’s full and unconditional acceptance of and agreement to comply with and be bound by the Terms and the decisions of PICO, and failure to do so may result in disqualification.


These Terms form a binding agreement between Pico Immersive Pte. Ltd., Pico Interactive Europe, S.L. (collectively, "PICO", "we", "us" or "our") and you. The entities that jointly organize this Competition in Regional 1 (as described in Section6 of the Terms) are Pico Interactive Europe, S.L. and Pico Immersive Pte. Ltd. However, Pico Immersive Pte. Ltd. is solely responsible for any payment, financial or tax obligations in relation to the Competition.
These Terms are subject to the PICO Terms of Service, PICO Terms of Service (for your residence in the EEA, the United Kingdom or Switzerland), PICO's Privacy Policy.


VOID OUTSIDE THE ELIGIBLE JURISDICTIONS AND WHERE PROHIBITED BY LAW.


I WHO IS ELIGIBLE TO PARTICIPATE
By participating in the Competition, you:

1. must meet the eligibility requirements as specified in these Terms. Failure to meet the eligibility requirements may result in an entry being invalid and/or forfeiture of any prize;
2. agree to be bound by these Terms;
3. must be a resident of a country listed in Region 1, 2, 3 (please find the countries listed in section 6 "PRIZES AND QUANTITY") and not use a VPN or other similar tools to participate in the Competition;
4. represent that you are at least 18 years old and have the authority to enter into these Terms personally.

1. must not permit or allow another person to take part in the Competition on your behalf.
2. are not under any legal or contractual obligation that would prohibit your participation in the Competition or receipt of a prize in the Competition.
3. PICO reserves the right to disqualify an entrant (referring to those who participate in the Competition) and forfeit their prize where PICO has reasonable grounds to believe there has been a breach of these Terms and/or where an entrant has gained unfair advantage in participating in the Competition and/or has used fraudulent means in connection with the Competition. PICO will be the final arbiter in any decisions, which will be final and binding.

II HOW TO QUALIFY AND HOW THE COMPETITION WORKS

1. HOW TO ENTER

Register on the online link (landing page link/H5 page) entering your details (Your PICO user ID and email address) and choose which Competition you want to participate in.

• Competition games: "All-in-One Sports" and "TempoClub".
• You must provide an accurate PICO user ID and email address as this will be the method to contact for the competition rules, challenges and also if you win a prize.
• This is the only entry route to the Competition and entries that do not comply with the above points will not be eligible.
• Participation in the Competition is not subject to payment.

1. TIMING

The Competition (including registration) starts from October 10th, 2024 at 10:00（GMT+8) and closes on November 3rd, 2024 at 23:59 local time (“Competition Period”). Any entries received outside the Competition Period will not be counted. Please be aware of:

• Registration: October 10th, 2024 at 10:00（GMT+8) and closes on October 15th, 2024 at 23:59 （GMT+8).
• Official Competition: October 16th, 2024 at 10:00 local time and closes on November 3rd, 2024 at 18:00 （GMT+8) . To avoid any doubt, the start time for Region 3 Singapore, Malaysia, Thailand should be 10:00 local time（GMT+8) .
• Prize Announcement: The week of November 11th, 2024, the Prize announcement will be made via PICO's official website and via email sent to each winner.

1. WHAT IS THE TASK

After registration, you could choose to attend either or both of the competitions below as you want. During the Competition Period, you can check the rankings of all regions per week.

• Competition 1:

Through All-in-One Sports game entrance in PICO, you will be able to find and play the 10 games that will be counted towards the 3-week challenge. These 10 games include: Basketball, Racketball, Archery, Volleyball, Table Tennis, Soccer, Boxing,Tennis, Badminton and Hockey.

• Competition 2：TempoClub.
  

1. WINNER SELECTION

• Scores ranking data will be provided as weekly ranking. This ranking will be shown once participants open the competition games and on the PICO website. The ranking will be updated once a week.
• Final awards will be judged by the 3-week total play scoring.

1. OTHER INFORMATION

There is no limit to the number of participants in the 2024 Intel x PICO VR Sports Competition.

1. PRIZES AND QUANTITY

• After the end of the Competition Period, for each region, the top 3 eligible participants who recorded the highest verified scores in each Competition will be declared as the winners (the “Winners”)
  
• Region 1 United Kingdom, Germany, Spain, France, Finland, Denmark, Sweden, Norway, Italy, Netherlands, Portugal, Austria, Switzerland, Poland:

• Prizes may be replaced with a substitute prize of equal or greater value, if circumstances beyond the PICO’s control make it necessary to do so. All prizes are non-transferable. Prizes are awarded “as is” with no warranty or guarantee, either express or implied.
• The winners must claim their prize by returning a message to our email address pico-mkt@bytedance.com within 5 days of notification. If a winner cannot be contacted or does not claim the prize within the specified time, we reserve the right to forfeit the prize and select a replacement winner from the pool of eligible entries (which shall be selected based on the next highest eligible score recorded at the Competition).
• The grant of Prize is final and non-disputable. We reserve the right to make our own judgement.

III GENERAL TERMS

1. PRIVACY AND DATA
   
1. To administer the Competition, evaluate, display, and communicate with you, conduct marketing and promotion of the Competitions, verify and announce Winners, fulfill prizes, and comply with applicable law, any personal data provided, will be collected and may be transferred outside your region or country,including to Singapore,and used and shared by, to, and among PICO and its affiliates, authorities and other participants.
2. PICO will collect and display to other entrants your nickname, profile and game results to publish your and other users' rankings. By entering and participating in the Competition, each entrant consents to have their information used as described above. Entry information received by PICO and its affiliates will be processed in accordance with PICO's Privacy Policy. You can access, delete, or correct personal data received by PICO by viewing respective policies and following the instructions provided.
3. PICO will collect the Winners` real name and bank account only for prize wiretransfer.
4. PICO recommend you avoid sharing personal details in the chat functions in the Competition games

1. LIMITATION OF LIABILITY & DISCLAIMER OF WARRANTIES

PICO shall not be liable for:

1. failed, or misdirected notifications, or notifications not received by the intended recipient in whole or in part or for computer or technical error of any kind;
2. any electronic miscommunications or failures, technical hardware or software failures of any kind, lost or unavailable network connections, or failed, incomplete, garbled or delayed computer transmissions which may limit your ability to participate in the Competition;
3. any technical malfunctions of the telephone network, computer system, computer equipment, software, program malfunctions or other failures, delayed computer transactions or network connections that are human, mechanical or technical in nature, or any combination thereof, including any injury or damage to your computer or mobile device related to or resulting from downloading any app or otherwise in connection with the Competition;
4. Provided that we have acted with professional diligence, we do not take responsibility for loss or damage caused by us, unless it is:

- caused by our breach of these Terms; or - reasonably foreseeable at the time of entering into these Terms (i.e. either it is obvious that it will happen or, at the time of this contract, it is known that it might happen).
We do not take responsibility for loss or damage if it is caused by events beyond our reasonable control.
Nothing in these Terms affects any statutory rights that you cannot contractually agree to alter or give up, or are legally always entitled to, for example, because you are a consumer.
We do not exclude or limit in any way our liability to you where it would be unlawful to do so. You will always have full protection of the laws that apply to you.

1. DISPUTES / GOVERNING LAW

These Terms are governed in accordance with, and all disputes arising out of or in connection with these Terms shall be subject to the applicable governing law and jurisdiction provisions of the PICO Terms of Service or PICO Terms of Service (for your residence in the EEA, the United Kingdom or Switzerland).
4. TAXES
All payments payable by PICO to you under these Terms are tax inclusive and each Party shall be responsible for its own taxes in accordance with applicable laws that are due in its own territory. You shall be responsible for the payment of all of its payable taxes in connection with these Terms. If any payments made by PICO under these Terms are subject to withholding tax levied by any governmental authority, PICO shall deduct or withhold such taxes and pay you the net amount after such taxes have been deducted or withheld.

1. LANGUAGE

These Terms may be made in any other language version as required by applicable laws and regulations. In case of any dispute or different interpretation between the English version and the other language version ("localized language"）, the localized language shall prevail.

1. SEVERABILITY

The invalidity, illegality, or unenforceability of the whole or any part of the Terms does not affect or impede the continued validity, legality and enforceability of the remainder of the Terms.

1. NO WAIVER

Our failure to insist upon or enforce any provision of these Terms shall not be construed as a waiver of any provision or right.

1. THIRD PARTY RIGHTS

A person who is not a party to these Terms has no right to enforce any of these Terms.

1. FORCE MAJEURE

We shall not be liable for non-performance, error, interruption or delay in the performance of our obligations under these Terms if this is due, in whole or in part, directly or indirectly, to an event or failure which is unavoidable, beyond our reasonable control, or which renders impossible the performance of such obligation.

1. SUPPLEMENTAL TERMS - JURISDICTION SPECIFIC
   
   South Korea If you are participating in the Competition in South Korea (“Korea”), the following additional terms apply. In the event of any conflict between the following additional terms and the provisions of the main body of the Terms, the following terms shall prevail. a. WHO IS ELIGIBLE TO PARTICIPATE Notwithstanding Paragraph eg. of “I. Who is eligible to participate”, PICO shall provide individual notice to the relevant entrant regarding PICO’s decisions for disqualification or forfeiture. In addition, the Terms shall be construed impartially in accordance with the principle of trust and good faith.
