This Consumer Health Data Privacy Policy supplements the CapCut Privacy Policy and applies to the CapCut mobile software application ("CapCut APP"), software applications deployed on the desktop ("CapCut Desktop version"), and the official CapCut website ("CapCut Web"), (collectively, the “Services”) accessed via any platform or device that link to this Consumer Health Data Privacy Policy. The Services are provided and controlled by Bytedance Pte Ltd. unless you are using our Premium Services in which case the controller is Bytedance Inc. (collectively, “CapCut”, “we”, or “us”). We are committed to protecting the privacy of consumer health data. In the event there are circumstances where some of the information we process may be considered “consumer health data” under Washington’s My Health My Data Act and other similar U.S. state laws, this Consumer Health Data Privacy Policy explains how we collect, use, and share such information.
Capitalized terms that are not defined in this Consumer Health Data Privacy Policy have the meaning given to them in the CapCut Privacy Policy.

1. What Consumer Health Data We May Collect

We may collect information from and about you, including information that you provide, information from other sources (e.g., third-party services and partners), and automatically collected information. While laws may not protect consumer health data you choose to make public, if you choose to engage in public activities on the Services, you should be aware that any information you share may be read, collected, or used by other users. You should use caution in disclosing personal information while using the Services.
The scope of consumer health data is defined differently under different laws, and the scope may be broader in some jurisdictions than others. For your information and awareness, we may collect the following information depending on your settings and how you use the Services:

• Information about your physical and mental health conditions, including information that could identify your attempt to seek health care services. This may include information that you or others choose to provide in the User Content you create, upload, generate, or access through the Services, including the photographs, images, and videos you upload, video templates you generate or view, comments you make, and other actions you take on the Services, such as liking content. For example, you or others may provide such information if you upload or edit non-public User Content depicting a health care center.
• Information about the videos, images and audio that are a part of your User Content, such as identifying the objects and scenery that appear, the existence and location within an image of face and body features and attributes, the nature of the audio, and the text of the words spoken in your User Content.
• Other information that may be used to infer or derive consumer health data.

2. How We May Use Your Consumer Health Data

We may use consumer health data to provide the Services experience, including to improve, support and administer the Services, and fulfill and enforce our Terms of Service. We may also use your consumer health data otherwise with your consent or in accordance with applicable law.

3. How We May Share Your Consumer Health Data

We may share personal information, which may include each of the categories of consumer health data as described above, as reasonably necessary to provide you the Services in the following manner:

• Within our corporate group.
• In connection with a sale, merger, or other business transfer.
• For legal reasons.
• Otherwise with your consent. For example, if you choose to allow a third-party service to access your account, we may share certain information about you with the third party depending on your permissions.

5. Privacy Policy Updates

We may amend or update this CapCut Consumer Health Data Privacy Policy from time to time. When we update this policy, we may notify you of changes by updating the “Last Updated/Effective Date” date at the top of the new CapCut Consumer Health Data Privacy Policy, posting the new policy, or by providing other notice required or permitted by applicable law.
